Une propriétaire met en oeuvre une garantie loyer impayés (GLI), contractée dans le cadre de la location de son logement auprès d’Action Logement et obtient une somme de plus de 15 000€ pour l’année 2007-2008. La société s’apercevant ensuite que le logement faisait l’objet de 2 arrêtés de péril, celle-ci assigne la bailleresse en nullité du contrat GLI pour dol et en restitution des sommes versées.
