La Cour de Cassation laisse le juge du fond libre d’évaluer le montant d’une indemnité d’occupation due par un occupant sans droit ni titre. En l’occurrence, elle ne souhaite pas donner d’avis sur la possibilité d’indexer cette indemnité sur un indice déterminé dans le bail de location précédemment résolu après acquisition de la clause résolutoire.

Le montant de l’indemnité doit pouvoir être librement estimé en fonction du principe de la réparation intégrale.
