Pas de dispense du paiement des loyers lorsque le logement n’est pas insalubre

Monsieur est locataire d’un logement privé. Les propriétaires ont délivré à leur locataire un commandement de payer visant la clause résolutoire, lequel les a assignés en exécution de travaux de mise en conformité du logement et en paiement de dommages et intérêts pour trouble de jouissance. Le locataire se pourvoit en cassation contre l’arrêt attaqué ayant prononcé la résiliation du bail.

La Cour de cassation confirme le jugement de la Cour d’appel en ce qu’elle a constaté que le logement n’étant pas insalubre, le locataire ne pouvait se dispenser du paiement des loyers.
